Trusts

 

The use of a trust can be traced as far back as the 12th century. During the time of the crusades, landowners that left England to fight were known to convey ownership of their lands to another person for safekeeping. During their absence the crusader would trust the holder of the lands to manage the estate and pay and receive feudal dues.  The understanding was that as soon as the knight returned his lands would be transferred back to him.   Over many years the trust as we know it today has evolved into a safe and secure instrument used in estate planning to ensure that the planner’s interests are protected. A trust can effectively be applied to reduce estate duty, protect moveable and fixed property from risk and ensure a long lasting legacy for your heirs. A trust should form an integral part of every prudent planner’s estate.

Trust Administration

 

The maintenance and management of any trust should be an ongoing process. Too often the administration of a trust can be neglected that could bring the validity and integrity of your trust into question. The use of a professional trustee can be a solution this problem. The appointment of an independent trustee has been advocated as good practice by our courts. When your trust is under scrutiny, the only proof that you have will be found in the records that you kept.
